A MESSAGE FROM
THE WINTER HEIGHTS BOARD OF TRUSTEES:

Community Meeting Review

On Wednesday evening, April 8, 2009 at the Universal Unitarian Church, 90 Shore Drive, the homeowners of Winter Heights came together to ask questions and get answers to a pressing issue regarding the newly discovered fact that the Trust did not own the land listed in the Trust Document.

Out of 116 total homes, 53 Winter Heights households unanimously voted in favor of the motion to request our attorney, Todd Helwig of Mirick O'Connell, intervene and work out a solution to the Azalea Drive property dispute by entering litigation and calling a meeting of the homeowners in 2 months to update the neighborhood on the status.

A discussion will take place at the next meeting to decide how to proceed if the issue is not resolved.  This step will be costly if we require a court order to have the developer convey the parcels of land to the Trust.

The City of Worcester saved us approximately $10,000 in litigation costs by taking the owner of 171 Chester Street to court last week.  For the time being, the land on Azalea Drive cannot be altered.  Thank you to everyone who took the time to call City Hall.  You made a big difference!  Thank you to the people at City Hall who took an interest in our community and partnered with us to make this happen so quickly.

Attorney Todd Helwig offered the following documents related to our cause, these documents are downloadable and printable; simply click on the links below:
